1. Who operates Worktree
Worktree is an early-stage project operated by four individual cofounders based in Texas, United States. Worktree is a project and trading name, not an incorporated company. In these Terms, ‘Worktree,’ ‘we,’ ‘us,’ and ‘our’ refer to the individuals identified as the operators in the final published version. Their full legal names must be added before these Terms take effect. Nothing in this draft represents that a corporation, limited liability company, or liability shield exists.

2. Scope and agreement
These Terms are intended to govern access to tryworktree.com, communications with our team, and hosted services that help approved devices discover, connect to, and coordinate around a shared project. They also govern any optional service functionality expressly offered under these Terms. They do not replace an open-source license that applies to software you receive.
The final Terms should be presented before a person first uses the hosted service, with a meaningful opportunity to read and accept them. Downloading source code or exercising rights under an open-source license does not by itself constitute acceptance of extra restrictions on that code. If you do not agree to applicable service terms, do not use the hosted service. You can retain rights already granted by the software’s open-source licenses.
If you use Worktree for an employer, organization, or client, you must have authority to connect its devices, share its materials, and authorize the actions you request. You remain responsible for respecting its internal policies. A display name or approved device does not independently prove a person’s identity, employment status, or authority.
3. Eligibility and access
The intended alpha audience is adults who can form a binding agreement and are legally permitted to use the service. Do not use the hosted alpha if you are under 18 or below the age of majority where you live. Worktree is not designed or offered as a service for children.
The current desktop does not require a Worktree account. Access instead depends on device-held credentials, approved project memberships, and the host’s settings. You must protect the computers and profiles that hold those credentials. Access to an unlocked computer, copied profile, or exported credential can give another person capabilities associated with that device. Contact the host and revoke affected access if you believe a device has been compromised.
We may require proportionate information to investigate abuse or verify a request. We do not promise to recover lost device keys, restore an identity after a reset, or transfer a project when its host is unavailable. Do not submit passwords or AI provider keys in support messages.
4. Alpha software and service availability
Worktree is experimental alpha software. Features, interfaces, compatibility, and stored-data formats may change. The app may crash, lose or duplicate work, mishandle a task, become unavailable, or require manual recovery. A feature demonstrated on the website may use scripted sample data; it is not a promise that an AI system will produce that result on your project.
The current alpha is offered without a service-level agreement, guaranteed uptime, guaranteed support response, or commitment to maintain a particular feature. We may limit capacity, pause enrollment, retire experimental functionality, or discontinue hosted services. Where practical we will provide advance notice of a material planned change, but urgent security or operational action may occur without advance notice.
Keep independent backups and use version control. Test Worktree on noncritical copies before relying on it. Do not make Worktree your only copy of a repository, record, credential, or important communication. You are responsible for deciding whether the alpha is appropriate for the sensitivity and consequences of your work.
5. Project hosts, guests, and permissions
A project host makes a selected project available to approved devices. The project and its runtime remain on the host computer. Invitations request admission; approval and the assigned permissions determine subsequent access. Hosts must invite only people they are authorized to involve and must review permissions before approving a device.
Shared sessions may contain prompts, files, tool results, agent messages, previews, and project context visible to authorized participants. Host approval is a trust decision. A guest must not use an invitation, credential, project connection, or permission for a purpose the host has not authorized. A host must not misrepresent what is being shared or expose another party’s confidential material without authority.
The current Off and Ask settings restrict ordinary file writes and raw terminal access for guests. Ask may still allow an individually approved command to execute. On and other authorized execution capabilities can run code with the host runtime’s operating-system privileges. Project permissions are application controls, not an operating-system sandbox. Plugins, shell commands, development servers, and other executable project content may affect resources beyond a single source file.
Revocation stops future authorized access as the relevant checks and leases take effect. It does not recall information already viewed or copied, reverse changes already made, retract data already sent to a provider, or guarantee cancellation of every previously started external operation. Hosts and guests must coordinate incident response and cleanup when access changes.
6. AI, automation, and your review duties
AI output can be inaccurate, incomplete, misleading, insecure, or inappropriate even when confidently presented. Agents may misunderstand a request, read unexpected context, modify the wrong file, run costly operations, or act on misleading project content. Cross-thread messages and coordination features help communicate work; they do not guarantee correctness, exclusive file ownership, conflict prevention, or safe concurrent changes.
Review code, commands, patches, dependencies, tests, and proposed external actions before relying on them. Use suitable approvals, backups, credentials with limited permissions, and separation from critical systems. You are responsible for authorizing deployments, spending, messages, and other actions performed using your systems and accounts.
Worktree is not intended to provide professional legal, medical, financial, or other regulated advice, or to operate safety-critical systems where failure could cause death, injury, or serious environmental damage. Do not use alpha output as the sole basis for a consequential decision. No statement that tests passed is a warranty that software is secure or fit for production.
7. Providers, integrations, and costs
You choose and connect your AI providers. Their contracts, acceptable-use rules, privacy practices, model availability, and prices apply independently. In the current sharing design, your provider connection is managed on your computer, including for a shared project. Relevant prompts and context still travel to the provider you select, and results may become visible in the shared session.
You are responsible for provider charges, subscriptions, computing, network usage, and other third-party fees generated by authorized use. Worktree being free does not make provider usage free. We are not responsible for a provider’s billing decisions, outages, retention practices, output restrictions, or cancellation procedures.
References to OpenCode, GitHub, AI providers, or other services identify compatibility or attribution. They do not imply sponsorship, certification, partnership, or that those organizations support Worktree. Links to the OpenCode community lead to an independently operated community with its own rules.
8. Your content and limited service permission
You retain whatever ownership and other rights you have in your source code, prompts, documents, messages, and other submitted materials. Worktree does not claim ownership of your project because you use the service. AI output may be similar to output provided to others and may not qualify for intellectual-property protection; you must check the rights needed for your intended use.
You give the operators and their service providers only the permission reasonably necessary to process information you send to the hosted service, transmit requested connections, respond to support requests, maintain security, and fulfill legal obligations. This is not a general license to publish your private repository or use your project content to train a model. Disclosures and processing are described in the Privacy Policy.
You must have rights and any necessary consents for materials and personal information you share. If you submit feedback, we may use the ideas to improve Worktree without payment or attribution, but that does not give us ownership of confidential project material or override obligations we separately accept. Do not send confidential feedback unless we have agreed how it will be handled.
9. Acceptable use
Do not use hosted Worktree services to obtain unauthorized access, impersonate another person or device, bypass an approval or revocation, harvest credentials, distribute malware, infringe rights, unlawfully disclose personal information, or conduct fraud, harassment, or other unlawful activity. Do not sell or disclose an invitation or credential in a way that defeats the host’s intended access controls.
Do not intentionally overwhelm the hosted service, evade rate limits or service restrictions, probe another user’s project without permission, or exploit a defect to access information you are not authorized to receive. Legitimate research on systems you control and responsible reporting to support@tryworktree.com are welcome; authorization for our production infrastructure or other users’ systems must be obtained separately.
These hosted-service restrictions do not limit rights expressly granted by an open-source license for software you possess. They do not prevent independent development, permitted reverse engineering, or lawful security research. A software license does not itself grant permission to attack or consume an operator’s hosted infrastructure.
10. Software, trademarks, and open source
Worktree incorporates OpenCode and other third-party components. Their applicable licenses, copyright notices, and attributions remain in force. The Software License and EULA page explains how those licenses relate to optional Worktree services. If these Terms conflict with an applicable open-source license about the licensed software, that license controls.
The Worktree name, site design, and branding are not a representation that you may impersonate the project or suggest an endorsement. No permission to use a third party’s trademarks is implied. Nothing here removes statutory fair-use, descriptive-use, or other rights you may have under applicable law.
11. Free alpha and future commercial terms
The current Worktree alpha has no paid Worktree plan and does not require an account-based subscription. Your independent provider and infrastructure charges remain your responsibility. These Terms do not authorize us to charge a payment method or automatically enroll you in a future paid product.
If we introduce paid functionality, the applicable price, billing period, cancellation terms, and any changed service terms will be presented separately before a purchase. We do not promise that future releases will have the same features, pricing, or availability as the alpha. Previously granted open-source rights are not revoked by a future pricing decision.
12. Suspension and ending use
You can stop using the website or hosted service at any time. Hosts can stop sharing, and guests can leave shared projects. Uninstalling the desktop or deleting local data does not necessarily remove server-side membership records, backups, support correspondence, or copies held by collaborators. Contact privacy@tryworktree.com for requests relating to information under our control.
We may restrict or suspend hosted access when reasonably necessary to address abuse, security risks, legal obligations, or operational integrity. Where appropriate and safe, we will explain the restriction and provide a way to contact us. Access restrictions do not eliminate rights in copies of open-source software already lawfully obtained.
Sections that by their nature need to survive ending use, including accrued obligations, intellectual-property provisions, disclaimers, liability limits, and dispute provisions, continue to the extent permitted by law. Retention of personal information remains subject to the Privacy Policy and applicable law.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE HOSTED ALPHA SERVICES ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE,’ WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, ACCURATE OUTPUT, SECURITY AGAINST EVERY THREAT, OR PRESERVATION OR RECOVERY OF DATA.
Advice, demos, documentation, support responses, or statements about intended behavior do not create a warranty beyond a separate written agreement expressly made by an authorized operator. Open-source components carry the warranties and disclaimers in their own licenses. Nothing in this section excludes a warranty or remedy that applicable law does not permit us to exclude.
14. Limits of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, OR DATA, ARISING FROM THE HOSTED SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS. THIS INCLUDES LOSS ARISING FROM AI OUTPUT, CONCURRENT CHANGES, A HOST OR PROVIDER OUTAGE, OR UNAUTHORIZED ACTIONS BY A THIRD PARTY, SUBJECT TO THE EXCEPTIONS BELOW.
For claims for which liability can lawfully be limited, the proposed aggregate cap for the operators together is the greater of US $100 or amounts you paid directly to Worktree for the affected hosted service during the 12 months before the event giving rise to the claim. Provider charges paid to a third party are not payments to Worktree. This cap is a draft commercial term requiring legal review before acceptance and publication.
These limitations do not exclude or limit fraud, fraudulent misrepresentation, intentional misconduct, gross negligence, liability for death or personal injury caused by negligence where that liability cannot lawfully be limited, or any other liability or consumer remedy that cannot be excluded or limited under applicable law. Mandatory local protections apply regardless of broader language elsewhere in these Terms.
15. Third-party claims
If you use the hosted service on behalf of a business, and to the extent permitted by law, you agree to compensate the operators for reasonable losses and costs resulting from a third-party claim caused by your unlawful conduct, your knowing infringement of that party’s rights, or your intentional misuse of the service. This provision does not apply to claims caused by an operator’s own breach, negligence, or misconduct, and does not impose an indemnity on consumers where prohibited.
The operator seeking compensation must give prompt notice, provide reasonable cooperation, and take reasonable steps to reduce loss. No settlement may admit wrongdoing by you or require nonmonetary obligations from you without your consent. The final scope of this provision must be reviewed for the actual users and contracting parties.
16. Disputes and governing law
Please contact support@tryworktree.com first so we can attempt to resolve a dispute informally. Include a description of the issue and a way to respond; do not include secrets. Informal contact does not prevent you from preserving a claim, seeking urgent relief, or exercising a statutory right.
Subject to mandatory law and nonwaivable consumer protections, these Terms are intended to be governed by Texas law, without applying conflict-of-law rules that would select another jurisdiction’s law. Courts of competent jurisdiction in Texas are the proposed forum for disputes, except where applicable law gives you the right to bring a claim elsewhere. This draft does not impose mandatory arbitration, a class-action waiver, or a shortened statutory limitation period.
17. Changes, notices, and interpretation
We may revise service terms as the product develops. Material changes should be announced on the website or through an appropriate in-app notice and assigned a new effective date. Where law requires consent or a new agreement, we will seek it; posting an update is not intended to substitute for a legally required acceptance process. Changes do not retroactively alter accrued rights without a lawful basis.
If a provision is unenforceable, the remaining provisions apply to the extent they can operate lawfully and independently. A failure to enforce a provision once is not a permanent waiver. These Terms, the applicable software licenses, and any separately agreed written terms describe the relevant relationship; a Privacy Policy explains processing and does not by itself create consent for every use of information.
If the team later forms a legal entity or transfers operation of the service, we will identify the new operator, provide appropriate notice, and follow applicable requirements for assigning agreements and transferring personal information. The Worktree name alone does not establish who has assumed an obligation.
